1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the casapilot.app website and the CasaPilot platform and services (collectively, the "Services"), provided by WEDEEN ("CasaPilot", "we", "us", or "our"), a company established in Ajman Free Zone, United Arab Emirates. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Services. By using the Services, you represent that you use them for professional purposes in connection with real estate activities.

3. Accounts and Access

• During the pre-launch period, access to the platform is limited and granted at our discretion.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• You must notify us promptly of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Services in violation of any applicable law or regulation.
• Infringe the intellectual property or other rights of any third party.
• Upload or transmit malicious code, or attempt to disrupt, compromise, or gain unauthorized access to the Services or related systems.
• Use the Services to send unlawful, abusive, or unsolicited communications.
• Reverse engineer, copy, or resell any part of the Services except as permitted by law.

5. Customer Data

You retain all rights to the data you submit to the Services ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Services, in accordance with our Privacy Policy and applicable data protection laws. You are responsible for ensuring you have the necessary rights and lawful basis to process the data you upload, including data relating to your own leads and contacts.

6. Intellectual Property

The Services, including all software, design, text, graphics, and trademarks (including the "CasaPilot" name and logo), are owned by WEDEEN or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Services.

7. Fees and Plans

Where applicable, fees for the Services are described on the Site or in a separate order. During the pre-launch period, pricing is indicative and may change. Any paid subscription will be subject to the terms communicated at the time of subscription.

8. Service Availability

We strive to keep the Services available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue all or part of the Services at any time, including during the pre-launch period.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, WEDEEN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Services. Our aggregate liability shall not exceed the amounts paid by you for the Services in the twelve (12) months preceding the event giving rise to the claim, or, where no amount was paid, a reasonable amount as determined by applicable law.

11. Indemnification

You agree to indemnify and hold harmless WEDEEN and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Services or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, particularly in the event of a breach of these Terms. Upon termination, your right to use the Services will cease immediately.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applicable in Ajman Free Zone, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be subject to the competent courts and authorities of Ajman, United Arab Emirates.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
